Terms of Service

By creating an account and using Empwr AI ("the Service"), you agree to the following terms and conditions. If you do not agree, do not use the Service.

1. License Grant

Empwr AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, professional use in evaluating physician economic value. You may not sublicense, distribute, or resell the Service or any data derived from it.

2. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code
• Redistribute, republish, or commercially exploit Service outputs without authorization
• Use automated scripts, bots, or scrapers to access the Service
• Misrepresent Service outputs as official valuations or legal/financial advice

3. CPT Content License

This Service incorporates CPT (Current Procedural Terminology) content, which is subject to the following terms:

You may not copy, modify, or distribute CPT content obtained through this Service except as permitted under your own AMA license agreement, if applicable.

4. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Empwr AI does not guarantee the accuracy, completeness, or reliability of any calculations, benchmarks, or reports generated. The Service is not a substitute for professional financial, legal, or medical advice.

5. Limitation of Liability

To the fullest extent permitted by law, Empwr AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.

6. Data Privacy and No PHI Uploads

Your use of the Service is subject to our Privacy Policy. We process your data securely and do not sell personal information to third parties. You retain ownership of the data you provide, and we use it solely to deliver and improve the Service.

Empwr AI is not a HIPAA Covered Entity or Business Associate. The Service is not designed to receive, store, or process Protected Health Information (PHI) as defined by 45 CFR 160.103. You represent and agree that you will not upload, transmit, or otherwise submit to the Service any documents or data containing patient identifiers — including but not limited to patient names, dates of birth, medical record numbers, Social Security numbers, addresses, phone numbers, email addresses, or any other element that would render the data PHI under HIPAA. Before uploading case logs or other documents, you are responsible for removing patient identifiers and using only de-identified data.

7. Intellectual Property

All intellectual property rights in the Service, including algorithms, designs, and proprietary methodologies, are owned by Empwr AI. Patent Pending.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately.

9. Changes to Agreement

We reserve the right to modify this agreement at any time. Continued use of the Service after changes constitutes acceptance of the updated terms.

10. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
